Lawsuit: Couple kicked out of Brad Garrett’s Comedy Club, assaulted | civil courts

Two people are suing the MGM Grand Hotel for assault and negligence after they say they were forcibly removed from the property after attending a celebrity comedy club.

In a lawsuit filed Wednesday in Clark County District Court, Gabriel and Amanda Ballejos allege they were “violently assaulted” and “physically restrained” after being escorted out of Brad Garrett’s Comedy Club, located at the MGM Grand, an MGM Resorts International property. They are suing three counts of assault and battery, negligent hiring, training and supervision, and negligent security.

MGM did not immediately respond to a request for comment.

According to the lawsuit, Gabriel and Amanda Ballejos were at Brad Garrett’s Comedy Club on December 19, 2023. During the show, the couple were approached by “representatives” of MGM Grand and asked to leave.

The plaintiff “willingly complied” and left the comedy club with several security officers, the lawsuit said.

As they continued toward the exit, plaintiff asked why they were being escorted from the property. When they reached the valet, cab and rideshare location, Gabriel was “physically brought to the ground and improperly restrained,” and he suffered injuries, according to the lawsuit. Amanda was “touched and physically restrained” as she tried to document the interaction and asked questions about the “unnecessary actions” of the security guards.

After the altercation, the plaintiffs were arrested and placed in separate holding rooms, their personal belongings taken from them, according to the lawsuit.

The reason why the plaintiff was escorted away from the property and that a physical altercation occurred is not mentioned in the application.

As a result, both suffered “significant physical and emotional harm and suffered losses,” the lawsuit alleges.

They are seeking general damages in excess of $15,000; special damages in excess of $15,000; reasonable attorneys’ fees and costs; interest according to statutory interest; and such other relief as the court deems just.
